TERMS AND CONDITIONS
Binding Agreement: Use of this MAK GRiLLS Mobile wireless web application (“MAK GRiLLS Mobile”) is available only to those users of MAK GRiLLS Mobile who agree to comply and be bound by these terms and conditions of use as well as other terms and conditions referenced on the MAK GRiLLS Mobile website at www.makgrillsmobile.com and the MAK GRiLLS main website at www.makgrills.com (collectively, the “Sites”). Any user of MAK GRiLLS Mobile or the Sites is hereinafter referred to as “By accessing, viewing, using, or downloading MAK GRiLLS Mobile or materials from the Sites, you agree to be legally bound by all of the terms, conditions and notices contained or referenced therein. All capitalized terms shall have the same meaning and effect as those referenced on the Sites.
Subject to Change: All content contained on MAK GRiLLS Mobile, the Sites, the terms and conditions of the Sites, and these terms and conditions are subject to change without notice, but the Company has no responsibility to update any information therein. Such changes, modifications, additions, or deletions shall be effective immediately upon posting new terms or conditions on the Sites.
Attended Appliance: The MAK GRiLLS product used in conjunction with MAK GRiLLS Mobile (the “Grill”) is an ATTENDED appliance. User must attend and monitor the Grill while it is in use, including while it is in use with MAK GRiLLS Mobile. Under no circumstances will the Company be responsible or liable to the User or any third party for any direct, incidental or consequential damages arising out of or resulting from the use of the grill or User’s failure to attend the grill, including undercooked or overcooked food, property damage, personal injury or death.
Food Quality Disclaimer: The Company disclaims any representations or warranties as to the safety or quality of any food product cooked with the Grill. User hereby agrees to follow all instructions, warnings, guidelines and recommendations described in the Grill product manual, including but not limited to those associated with the proper handling and cooking of various food products. Under no circumstances will the Company be liable to the User or any third party for any direct, incidental or consequential damages arising out of User’s failure to follow such instructions, warnings, guidelines and recommendations.
Disclaimer: YOU EXPRESSLY AGREE THAT YOUR USE OF MAK GRiLLS Mobile IS AT YOUR SOLE RISK. MAK GRiLLS Mobile, the SITEs, MATERIALS, CONTENT, RELATED COMMUNICATIONS AND SOFTWARE MADE AVAILABLE ON THE SITES ARE PROVIDED "AS IS" WITHOUT ANY REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT OR FITNESS FOR PARTICULAR PURPOSE. SOME JURISDICTIONS DO NOT ALLOW FOR THE EXCLUSION OF IMPLIED WARRANTIES, SO THE ABOVE EXCLUSIONS OF IMPLIED WARRANTIES MAY NOT BE APPLICABLE UNDER CERTAIN CIRCUMSTANCES. THE COMPANY DOES NOT WARRANT THE ACCURACY OR COMPLETENESS OF THE MATERIALS OR CONTENT DISPLAYED OR DISTRIBUTED ON MAK GRiLLS Mobile, INCLUDING BUT NOT LIMITED TO THE RELIABILITY OF ANY ADVICE, STATEMENT, ADVERTISEMENT OR OTHER INFORMATION DISPLAYED OR DISTRIBUTED THROUGH Mak Grills Mobile AND THE SITEs. USER ACKNOWLEDGES BY THE USE OF MAK GRILLS MOBILE AND THE SITES THAT ANY RELIANCE ON ANY SUCH MATERIALS, CONTENT, ADVICE, STATEMENT, ADVERTISEMENT OR INFORMATION SHALL BE AT the user’s SOLE RISK.
THE COMPANY DISCLAIMS ANY WARRANTIES FOR THE SECURITY OR RELIABILITY OF THE sites. THE COMPANY DOES NOT ASSUME ANY RESPONSIBILITY, AND SHALL NOT BE LIABLE FOR ANY DAMAGE TO, ERRORS or MALFUNCTIONS OF user’s software or hardware, OR VIRUSES OR OTHER HARMFUL COMPONENTS THAT MAY INFECT YOUR COMPUTER EQUIPMENT OR OTHER PROPERTY ON ACCOUNT OF YOUR ACCESS TO OR USE OF MAK GRILLS MOBILE AND THE SITES.
THE MATERIALS INCLUDED IN MAK GRILLS MOBILE AND THE SITES MAY CONTAIN INACCURACIES AND TYPOGRAPHICAL ERRORS. THE COMPANY RESERVES THE RIGHT, IN ITS SOLE DISCRETION, TO CORRECT ANY ERRORS OR OMISSIONS IN ANY PORTION OF MAK GRILLS MOBILE and the sites. THE COMPANY MAY MAKE ANY OTHER CHANGES TO MAK GRILLS MObILE, THE SITES, THE MATERIALS AND THE PRODUCTS, PROGRAMS, SERVICES OR PRICES (IF ANY) DESCRIBED ON MAK GRILLS MOBILE AND THE SITES AT ANY TIME WITHOUT NOTICE.
